The Modern Divorce Procedure in the UK

Ways of Getting a Divorce

What are the avenues by which one may obtain a divorce? It depends on three basic factors – circumstances, money and time – and one has to choose accordingly.

  • If the case is complicated, involves heavy assets, a lot of property, child custody, convoluted inheritance matters, third party involvement, children out of wedlock and criminal charges (or their possibility), it is best to approach a law firm. The money spent now will save a lifetime of woes.


  • If the people concerned are celebrities, it is still better to go to a law firm even for an amicable parting, because the press needs to be handled in a certain way and asset management is also required.


  • For those who don’t have much time, a managed divorce service from any of the online firms is a good idea. The costs are low, and it can’t get any faster than this.


  • The most economical option is DIY divorce, where one needs to buy or download a divorce package and conduct the legalities themselves. Please note -- both of these methods apply only to amicable settlements where one need not fight a case.


Steps to the Divorce

What are the steps to getting a divorce? In the first place, you must be married for at least a year to be divorced from your spouse. This pertains to same gender marriages as well. To begin with, one of you will apply for the divorce by filling up the relevant forms. You will, therefore, initiate the process by submitting these to the court. The court will look through them and ask your spouse to answer by agreeing or disagreeing to the divorce. He or she is going to be the Respondent. Thereafter, the court will look through everything, consider both your versions, and grant the decree nisi. This is not the final verdict, which will be the next step, called the decree absolute. There are gaps between all the steps to allow the court to process the documents and the couple to think about it and prepare accordingly.

Important Documents

The outline provided above is a bare skeleton of what happens. There are a lot of documents and formalities involved in the whole process. Some of the most important documents that a divorce may involve are:

  • The Separation Agreement: This is not the divorce document, but an agreement agreed upon by both partners, concerning children, property, assets, money management etc. Once the court sanctions this, both partners are bound to adhere to it, and will be punished if they don’t.

  • Child Custody Agreement: This will be an agreement deciding the maintenance, custody and visitation rights.


  • Will: Making new wills is strongly recommended. If you had pre-existing ones, change them.


Grounds of Divorce

What are the grounds on which divorce can be granted?

  • Infidelity: It needs to be proved conclusively in the court that the spouse concerned has been unfaithful to the marriage, and has had physical relations with another adult. All proofs required for this must be submitted and the court would also require testimonials.


  • Unreasonable Behaviour: This is a very wide category, and ranges from physical and emotional abuse to irritating habits. The court must be satisfied that the reasons are serious enough for the marriage to be annulled. If needed, it may involve criminal charges and the proceedings will change accordingly.


  • Abandonment: It needs to be proven clearly in court that the partners have had no contact whatsoever, through visits, letters, internet or phone for a specified number of years, for this to be granted. Any record of contact will jeopardize the case.


  • Separation with Consent: This is the increasingly popular amicable divorce proceeding that one hears of. It must be proved that the partners have been separated from each other for a period of three to five years with mutual consent and are not living as man and wife at present.
